Types of cannabis licences

In Yukon, there are two types of licences available for businesses interested in the sale of cannabis: sub-class 1 and sub-class 2. Sub-class 1 is a ‘store-within-store’ model and the sub-class 2 is a ‘stand-alone store’ model.

Provisions and requirements apply to both licences

Premises and personnel

  • Consumption of cannabis is not allowed within the licensed premises. This may change in the future based on federal rules for edibles.
  • Licensees and employees related to either licence must submit criminal record checks and complete Yukon Liquor Corporation (the distributor corporation) approved server training.
  • Licensee must ensure location is secure with a burglar alarm and video surveillance system, where the burglar system is installed and monitored by an agent or agency legally providing these services in Yukon. The surveillance system design and monitoring plan must be submitted and approved by the Yukon Liquor Corporation.
  • The Regulation sets the maximum hours of operation from 9:00 a.m. to 2:00 a.m. Municipalities can further limit the hours of operation through bylaws.
  • The setback is 150 metres from an elementary or secondary school, unless varied by a municipal bylaw or Ministerial Order.

Product

  • All cannabis products for resale by licensee must be purchased from the Yukon Liquor Corporation.
  • A licensee is required to arrange their own transportation of cannabis product from Yukon Liquor Corporation to the licensed premises.
  • Retailers must sell product in its original and sealed package.
    • No bulk bin or self-serve is permitted.
    • Display containers (i.e. smell jar) are permitted as long as containers are secure.
  • Cannabis products may not be opened or consumed within the store.
    • For returns, the licensee must facilitate the return as quickly as possible, and secure the product left on site.
  • Licensees will have to track and report sales to Yukon Liquor Corporation to fulfil its obligation for seed-to-sale tracking to Health Canada.
    • Retailers will be required to report their financial and product inventory information (e.g. sales, volume, products sold, loss, returns) on a monthly basis.

Sub-class 1: store-within-store

The store-within-store model allows for a main retail operations area and a dedicated cannabis area. A dedicated cannabis area is located within the overall licensed premises. There must be a clear separation between the two sales areas with two separate dedicated checkout counters.

Licensed premises overall:

  • May permit persons under 19 years of age.
  • May sell any products, goods or services in the non-cannabis retail area, other than cannabis and cannabis accessories.
  • Tobacco and alcohol are prohibited in either area, unless permitted by a municipal bylaw or a Ministerial Order.

Dedicated cannabis area:

  • Persons under 19 years cannot enter the dedicated cannabis area.
  • Only cannabis and cannabis accessories may be sold; no other sale of goods or services.
  • Cannabis purchases must be completed within the dedicated cannabis area.
  • Cannabis cannot be seen or accessed from non-cannabis areas.

Sub-class 2: stand-alone store

The stand-alone store model is a cannabis retail store, like Cannabis Yukon, where only cannabis and cannabis accessories may be sold in the store.

Licensed premises:

  • Persons under 19 years cannot enter.
  • Only cannabis and cannabis accessories may be sold; no other sale of goods or services.
  • Cannabis cannot be seen or accessed from outside the area.
  • Tobacco and alcohol are prohibited in the area, unless permitted by a municipal bylaw or a Ministerial Order.
